Layer one: fitting the EB-2 category

Before the waiver is even considered, you must qualify for EB-2 itself, one of two ways. The advanced degree route: a U.S. master’s or higher (or foreign equivalent), or a bachelor’s plus five years of progressive experience in the specialty. The exceptional ability route: at least three of six criteria, including a degree relating to your field, ten years of full-time experience, a license, high salary, memberships, and recognition for achievements.

Layer two: the three Dhanasar prongs

  • Substantial merit and national importance. Frame a specific endeavor and show why it matters at a national scale: economic impact, health, security, energy, technology. National importance is about the endeavor’s reach, not your resume.
  • Well positioned to advance it. Education, past success, funding, customers, a concrete plan. This prong is about YOU delivering THIS endeavor.
  • The balance test. Show why, given the first two prongs, forcing a job offer and labor certification would deprive the U.S. of the benefit.

The evidence that actually carries cases

Recommendation letters matter, and independent letters from experts who never worked with you outweigh letters from friends and supervisors; most cases file with four to seven. Beyond letters: citations or adoption of your work, revenue and jobs if you are a founder, contracts, patents in use, press, and a business or research plan that reads like you have done this before. A request for evidence usually attacks prong one framing or prong two proof, which is why the endeavor statement deserves the most drafting time.
